Welcome to Oderum! These Terms of Service ("Terms") govern your use of the Oderum website and services (collectively, the "Service") operated by Oderum ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Oderum is a fragrance review and discovery platform that provides:

• Fragrance Database: Comprehensive catalog of fragrances with detailed information
• Review System: Platform for users to write and read fragrance reviews
• Personal Lists: Tools to create and manage fragrance collections
• AI Recommendations: Scentient feature for personalized fragrance suggestions
• Daily Tracking: Hint feature to log daily fragrance wear
• Custom Tools: Pyramid builder and note preference tracking

3. User Accounts

Account Registration

To access certain features, you must create an account by providing:

• A valid email address
• A unique username
• Acceptance of these Terms and our Privacy Policy

Account Security

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Username Policy

Usernames must not:

4. Subscription Services

Service Tiers

Billing and Payment

• Subscriptions are billed monthly in advance
• Payment processing is handled securely by Stripe
• Prices are subject to change with 30 days notice
• All fees are non-refundable except as required by law

Cancellation

You may cancel your subscription at any time through your account settings or Stripe billing portal. Cancellation takes effect at the end of your current billing period. You will retain Pro features until the end of the paid period.

5. User Content

Content You Create

You may create and share the following content on Oderum:

• Reviews: Written reviews and numerical ratings (public)
• Lists: Fragrance collections (public or private)
• Custom Pyramids: Personal fragrance note combinations
• Daily Tracking: Personal fragrance wear records

Content Standards

All user content must:

• Be honest, accurate, and based on your genuine experience
• Respect others and avoid harmful, offensive, or discriminatory language
• Not contain spam, promotional content, or commercial solicitation
• Not violate any laws, regulations, or others' rights
• Not contain personal information about others without consent

Content Ownership and License

You retain ownership of your content. However, by posting content on Oderum, you grant us a worldwide, non-exclusive, royalty-free license to use, display, distribute, and modify your content for the purpose of operating and improving our Service.

Public Content: Reviews and public lists may be displayed to other users and search engines. By making content public, you acknowledge it may be shared and referenced by others.

6. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Post false, misleading, or fraudulent reviews or information
• Attempt to manipulate ratings or game the system
• Harass, abuse, or harm other users
• Upload malicious code, viruses, or harmful content

• Create multiple accounts to circumvent usage limits
• Use the AI features for commercial purposes without permission

7. AI Services and Scentient

Our Scentient AI recommendation feature processes your natural language requests to suggest fragrances. By using this feature:

• Your prompts may be processed by third-party AI services (OpenAI)
• Usage is subject to monthly limits based on your subscription tier
• Recommendations are automated and may not always be accurate
• You should not include personal or sensitive information in prompts
• Commercial use of AI features requires explicit permission

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you also agree to our Privacy Policy.

9. Intellectual Property

Platform Rights

The Oderum platform, including its design, features, algorithms, and content (excluding user-generated content), is owned by us and protected by intellectual property laws.

Fragrance Information

Fragrance names, descriptions, and related information are provided for informational purposes. Trademark rights belong to their respective owners.

DMCA Policy

We respond to valid copyright infringement notices. If you believe your copyright has been infringed, please contact us with detailed information about the alleged infringement.

10. Disclaimers

The Service is provided "as is" and "as available." We make no warranties about:

• Service availability, reliability, or uninterrupted access
• Accuracy of fragrance information or user reviews
• Suitability of AI recommendations for your preferences
• Compatibility with your devices or systems
• Freedom from errors, bugs, or security vulnerabilities

Fragrance Recommendations: All recommendations, whether from AI or user reviews, are subjective opinions. Individual reactions to fragrances may vary. We are not responsible for allergic reactions or dissatisfaction with fragrances.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount paid by you to us in the twelve months preceding the claim.

12. Account Termination

Termination by You

You may delete your account at any time through your account settings. This will permanently remove all your data, including reviews, lists, and tracking history.

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or harmful activities
• Create fake reviews or manipulate the platform
• Fail to pay subscription fees (for Pro accounts)

Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• Your public content (reviews) may remain visible
• Your private data will be deleted according to our Privacy Policy
• Subscription charges will cease (no refunds for partial periods)

13. Dispute Resolution

These Terms are governed by the laws of the United States and the state where Oderum is incorporated, without regard to conflict of law provisions.
